25 Feb What Benefits Fall Under Public Charge?
With the public charge rule coming into enforcement on February 24th, 2020, there is some confusion of what public benefits will count towards being considered a public charge. Starting February 24, 2020, USCIS will begin evaluating applicants using the totality of the circumstances. While evaluating the totality of the circumstances USCIS will also take into consideration the use of and or the possible future use of public benefits in order to deem the applicant inadmissible into the United States. The list below contains the public benefits that will now be considered a public charge by USCIS. This list is not all encompassing, and you should always consult an attorney to determine if the public benefit you are receiving falls under the public charge rule.
